No-dues certificate from a housing society: when you need it and how to issue it

When a member sells a flat, takes a home loan or transfers shares, the buyer or bank usually asks for a no-dues certificate from the society. It's a simple letter, but delays are a common complaint.

What it is

A no-dues certificate confirms that a member has paid everything owed to the society up to a date: maintenance, funds, interest and any other charges.

When members need it

  • Selling the flat: buyers and their banks ask for it.
  • Taking or transferring a home loan.
  • Transferring the share certificate, including after a member's death.

What it should contain

  • Society name, registration number and address.
  • Member's name, flat number and share certificate number.
  • The date up to which all dues are paid.
  • Date of issue, and signature of the secretary or treasurer with the society's stamp.

Issuing it quickly

Most delays come from checking the ledger by hand. If the society's accounts are up to date, the treasurer only needs to confirm that nothing is outstanding. Agree in the committee who can sign, and how quickly requests will be handled.

On a transfer, the society can't charge more than the transfer premium its bye-laws allow; in Maharashtra a government order caps it at ₹25,000.

Frequently asked questions

Is a society NOC needed to sell a flat?

Banks and buyers usually ask for one, along with the no-dues certificate. What the society can require on a sale is set by its bye-laws and the co-operative societies law; it can't refuse without reason.

Can the society charge for the certificate?

Only a nominal fee, if the bye-laws or the general body allow it.
